House Republicans want to use the US Constitution’s “Insurrection Clause” to stop Zohran Mamdani from becoming New York Mayor even if he wins the elections. The story was first reported by the New York Post. Representative Andy Ogles later confirmed the report on X.
The 14th Amendment of the US Constitution bars individuals who have “engaged in insurrection or rebellion” or has “given aid or comfort to the enemies” of the nation from taking office. House Republicans say that Mamdani’s comments against ICE could violate the clause.

Ahead of the Presidential Elections last year, Colorado had attempted to use the same clause to remove Donald Trump from the ballot. However, the Supreme Court decreed that it was up to the US Congress to enforce the clause.
Republican Congressman from Tennessee, Andy Ogles is one of the primary forces driving the campaign against Mamdani. He has called for Mamdani’s deportation for his “refusal to disavow violent anti-American rhetoric.”

In a letter to Attorney General Pam Bondi, he asked for an update on the steps taken to “determine whether denaturalization proceedings are warranted.” On X, Ogles claimed Zohran Mamdani wanted “to turn America into an Islamic theocracy.” On Tuesday, he shared a video of the 9/11 terror attack in a not-so-subtle jibe at Mamdani for his Muslim faith.
Stefano Forte, president of the New York Young Republicans, said, “There is a real and legitimate push to see the insurrectionist Zohran Mamdani either a) removed from the ballot or b) removed from office if he is to win on Tuesday.”
Republican Rhetoric against Zohran Mamdani
Republicans have regularly accused the NYC Mayoral elections frontrunner of being a communist. Top Republicans, including President Donald Trump, have called him a Communist. Texas Senator Ted Cruz shared a meme describing Mamdani as a ‘Communist Jihadist’.

Nevertheless, Mamdani has consistently maintained that he is not a Communist. He said last weekend, “No matter how many times these Republican Congress members or the president of this country calls me a Communist, it doesn’t make it true.”
Mamdani’s rants against PM Modi
Meanwhile, Mamdani made criticising Indian Prime Minister Narendra Modi a ritual on the campaign trail. Time and again, he told crowds that he is not fond of PM Modi. While he carefully avoided questions related to Israel saying he was running for NYC Mayor, he conveniently raked up PM Modi regularly during his campaign.
During Diwali festivities, he told a crowd that he was critical of the Indian PM because they were not inclusive. He said, “Modi and the BJP have room only for certain kinds of Indians.” Mamdani said that he knows many New Yorkers from the Indian diaspora feel differently about PM Modi. He said it’s their right and he will represent them all the same.
Earlier, he had called PM Modi a “war criminal”. Mamdani said that people should view him the way they see Benjamin Netanyahu.
